Abstract
With the reform of the divorce in 2007, the Belgian legislator displaced the serious fault focus towards the state of necessity of the compensatory pension beneficiary. Nevertheless, the legal change did not eliminate completely the serious fault in the judicial discretion respect to the granting (or not) of the “pension alimentaire”.
