Abstract

Abstract:This contribution will explain the main current issues on the relation between public and judicial enforcement, matters analysed from the spanish legal system point of view and the european legal requirements, mainly the Council Regulation 1/2003, the Directive on Antitrust Damages Actions adopted on 11 June 2013 and the recently approved Directive on 26 November 2014. The study will analyse the relation between both of these aplication ways and moreover the problem about the dependence of the judicial resolution to the National Competition Autohority decision as the article 16 of the Regulation 1/2003 provides for the uniform application of Community competition law and the "non- contradiction principle" between the decisions contemplated.
