Abstract

Antitrust damages actions in Spain involves a civil proceeding before the courts where the procedural rules are an alternative key rule for both parties.The current study tries to analyze the main issues on the judicial enforcement from the procedural point of view. Questions like joining actions by the claimant who establishes the sequence or priority of his actions in order to determinate the competence of the civil court or even when the competition law is argued by the defendant not by the plaintiff. In this regard, we propound other defence strategies, the cross-claim for instance, when the defence becomes an attack or another alternative like the peculiarity case of preliminary issues. Besides, the passing on defence allowed by the Directive 2014/104 and the prescription by lapse of time of the claim for damages.
