Abstract

The private enforcement of the Competition law in the international scenario involves an added difficulty for the claimant who starts an antitrust cross-border litigation. This study proposes an analysis focusing on the main key aspects of an international antitrust civil suit, considering specially the latest ECJ case of 24 November 2020, C-59/19, Wikingerhof GmbH & Co. KG & Booking.com BV in order to establish the competent court to judge an anti-competitive action based on a dominant market position abuse
