Resum

One of the main issues of the procedural strategy at the civil process which envolves the antitrust damages actions is defining the public and the private enforcement, once the right to be repared by an infrigment of competition law has been recognized and consolidated. The study will analyze deeply the private enforcement in its two aplication ways, the follow-on and stand alone actions, regarding the current resolution of the Supreme Court March 8 of 2022, n 198/2022, case Monte Real/Repsol.
