Abstract

The public health crisis stemming from Covid-19 updates the “technocratic fallacy” by reducing ethical issues to mere technical issues. Clinical uncertainty seeks refuge in the Law and “defensive medicine” acquires a renewed force. Fundamental rights, as legal grammar of the clinical relationship, becomes a relevant approach to analyze this medical practice. Thus, it is possible to conclude that defensive medicine violates its characterizing features and, conversely, the authentic clinical relationship, based on trust and recognition, avoids it.
