Abstract

The last draft regulation to promote the mediation could be the best opportunity to change from a traditional system of judicial administration —through the courts of which debilities have been increased after the Covid-19 Crisis— towards an alternative resolution to ensure the right to justice such as mediation. Considering that this alternative dispute resolution is not a new way to proceed but it is a novel mandatory resource to be implemented in certain subjects. Moreover, mediation would be used as an action prior to jurisdiction.
